Introduction
These Terms and Conditions (“Terms”) govern all transportation and logistics services (“Services”) provided by MTC Logistics Services (“MTC Logistics,” “we,” “our,” or “us”) to any customer (“Client,” “you,” or “your”). By engaging MTC Logistics, you agree to be bound by these Terms. If you do not agree, please refrain from using our Services. These Terms aim to ensure a clear understanding of the responsibilities, liabilities, and expectations for both MTC Logistics and our Clients.
Scope of Services
We provide nationwide road transportation solutions, including but not limited to:
- Full Truckload (FTL) transportation
- Full Trailer Load services
- Containerized cargo transportation
- 19 Ft vehicle transport
- Time-bound deliveries
Our services accommodate a range of industries and permitted goods, including bulk minerals, industrial machinery, FMCG products, automotive parts, pharmaceuticals, and chemicals. Services are performed subject to availability, vehicle capacity, and compliance with applicable laws.
Service Execution
- MTC Logistics reserves the right to determine the most suitable routes, vehicles, and operational methods unless otherwise agreed in writing.
- We may execute services directly or through authorized subcontractors, affiliates, or fleet associates.
- Pickup and delivery times are provided as estimates based on normal operating conditions and are not guaranteed unless expressly agreed in writing.
- We reserve the right to consolidate shipments, where appropriate, for operational efficiency unless an exclusive arrangement has been confirmed.
Client Responsibilities
The Client must:
- Provide complete and accurate shipment details, including weight, dimensions, cargo description, and precise pickup and delivery addresses.
- Ensure goods are packaged and secured in a manner suitable for transport.
- Adhere to all applicable laws, regulations, and industry standards relevant to their shipment.
- Notify MTC Logistics of any hazardous, fragile, or special-handling requirements before booking.
- Ensure prompt availability of goods for loading and timely unloading at destination.
Prohibited Goods
Unless agreed in writing and compliant with applicable laws, the following items are prohibited:
- Hazardous materials, explosives, or flammable substances without prior approval
- Perishable goods without appropriate arrangements
- Contraband or illegal items
- Currency, negotiable instruments, or high-value items requiring specialized security measures
- Goods prohibited by law for transportation by road
Charges and Payment
- All charges will be mutually confirmed before the commencement of transport.
- Unless otherwise agreed, payment is due as per the terms stated in the service agreement or invoice.
- Late payments may incur interest, penalties, or suspension of ongoing and future services.
- Additional charges may apply for waiting times, route diversions, or extra handling not included in the initial agreement.
Liability and Insurance
- MTC Logistics will take reasonable care in handling and transporting goods.
- Our liability for loss, damage, or delay is limited to the lower of the declared value of goods or applicable statutory limits.
- Clients are strongly encouraged to obtain their own cargo insurance for high-value or sensitive goods.
- We are not responsible for loss or damage arising from events outside our reasonable control, including but not limited to accidents, theft, natural disasters, or delays caused by regulatory inspections.
Force Majeure
MTC Logistics shall not be held liable for delays or service failures caused by events beyond our reasonable control, including acts of God, severe weather, strikes, labor disputes, road closures, or government-imposed restrictions.
Claims and Complaints
- Any claims for loss, damage, or delay must be submitted in writing within 7 days from the delivery date or the date the shipment should have been delivered.
- Claims must include supporting documents such as delivery receipts, photographs, and any relevant correspondence.
- MTC Logistics will review claims in good faith and respond within a reasonable period.
Indemnity
The Client agrees to indemnify and hold MTC Logistics harmless from any claims, liabilities, costs, or damages resulting from:
- Breach of these Terms
- Transportation of prohibited or misdeclared goods
- Third-party claims arising from the Client’s actions, omissions, or non-compliance with applicable laws
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
Amendments
MTC Logistics reserves the right to modify these Terms at any time. The updated Terms will be posted on our official website and will apply to all new bookings made thereafter.
